These Terms of Use (“Terms”) govern your access to and use of the website located at useheady.com (the “Site”), operated by The Heady Collective, LLC, a Delaware limited liability company doing business as Heady (“Heady,” “we,” “us,” or “our”). These Terms govern use of the Site only. They do not govern any services we provide under a separate written agreement; those engagements are governed by the contract signed between you and Heady, which controls in the event of any conflict with these Terms.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site. By using the Site you represent that you meet this requirement. The Site contains information relating to the cannabis industry and is intended for business and professional audiences; it is not directed to minors.

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the Site. You agree not to:

  • attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • interfere with or disrupt the Site or its infrastructure;
  • use automated means (bots, scrapers, crawlers) to access or harvest data from the Site except as permitted by our robots directives;
  • submit false, misleading, or unlawful information through any form on the Site;
  • use the Site to transmit malicious code or engage in any fraudulent or harmful activity.

The Site and its contents — including text, graphics, logos, the Heady name and brand, design, and code — are owned by or licensed to The Heady Collective, LLC and are protected by intellectual property laws. “HEADY” and “HEADY COLLECTIVE” are trademarks of The Heady Collective, LLC. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission, except for personal, non-commercial viewing.

5. Submissions through forms

If you submit information to us through a form on the Site (for example, the contact form), you represent that the information is accurate and that you have the right to provide it. How we handle that information is described in our Privacy Policy. Do not submit confidential information you do not wish to share, and do not submit personal information of others without their permission.

Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

You agree to indemnify and hold harmless The Heady Collective, LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.

We may update these Terms from time to time. Changes are effective when posted to this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
